When to Arrange Your Contract
You should get your contract prepared ASAP. We strongly recommend having your contract drawn up in advance to avoid delays or issues down the track when you have an offer you want to accept. Ensuring your contract is drafted by professionals means the appropriate wording of special condition clauses gives you a high level of protection as the seller.
Does PropertyNow Offer Conveyancing Services?
Yes. Whilst conveyancing and contract preparation is not included in our core service fee. We have partnered with a national law firm that specialises in conveyancing to allow you to arrange contract preparation in just a couple of clicks.
- Expertise: They are highly experienced, qualified property lawyers (meaning they can provide legal advice if things go wrong).
- Digital Platform: They offer a streamlined digital platform, allowing you to stay in the loop 24/7 with access to documents, updates, and messages.
- Disclosure: While we wholeheartedly recommend our legal partner based on their excellent service, as a licensed agent, we are required to disclose that we do receive a referral fee if you decide to purchase their services.
How the Costs Work
The costs are split into two distinct parts:
- Part 1: Upfront Contract Preparation: This is an optional enhancement you can add to your cart when checking out, or anytime after. The upfront fee covers the drafting of your contract and the required title searches. You can find current prices for your state and property type within your account.
- Part 2: Full Settlement Service: For ultimate simplicity, you can arrange to have our partner firm handle your entire sale and settlement process. This is a separate cost, which is not paid upfront. It is paid out of your settlement funds directly to the firm.
Potential Additional Exclusions
While the upfront contract preparation fee covers standard legal fees and estimated expenses, some specific third-party costs are excluded from the initial purchase cost. These are usually recovered at the earlier of settlement or 90 days. Generally exclusions are as follows but for current exclusions you can view the description of your contract preparation when checking out, or discuss with the laywers after purchase.
- NSW: Non-metro sewer mains/water diagrams, Council land certificate, Land tax certificate, Rural water information statement, Dealings on title (>3) or CP title (>5), Urgency fees, Verification of identity, Merchant fees, Fast/secure upgrade fees.
- VIC: GAIC certificate, Dealings on title (>1), Verification of identity, Merchant fees.
- QLD: Additional searches for secure seller disclosure statement, Urgency fees (Form 33/34), Verification of identity, Merchant fees.
- WA: Verification of identity, Merchant fees.
- SA: Form 1 vendor statement, Section 41 Strata, Verification of identity, Merchant fees.
- ACT: Dealings on title (>1), Merchant fees, Urgency fees. Buyer usually reimburses seller for building, pest & compliance report and S119 certificate (strata).
- NT: Verification of identity.
- TAS: Verification of identity, Merchant fees.
