# Leaving your agent to sell privately: how it works

Plenty of our sellers come to us after a stint with an agent. The move is straightforward; the one thing to check before you list is the agreement you signed with the agent.

### We're a licensed agency, so the portals accept your listing

realestate.com.au and Domain only take listings from licensed agents. PropertyNow holds real estate licences in every state and territory, so your listing is published under our licence and shows our contact details rather than yours. That's also why the portals let you leave an agent and list with us: you're moving from one licensed agency to another. See [Is PropertyNow a licensed real estate agency?](https://help.propertynow.com.au/en/article/is-propertynow-a-licensed-real-estate-agency-a3044x/).

### Your agreement with the agent decides when you can list

* **Exclusive agency:** the agent is usually entitled to commission on any sale during the term, however the buyer is found, and we generally can't publish until the agreement ends or the agent releases you in writing. See [I have an exclusive agreement with an agent](https://help.propertynow.com.au/en/article/i-have-an-exclusive-agreement-with-an-agent-can-i-still-list-rthvf5/).
* **Sole agency:** you can usually sell privately yourself, but commission may still be payable if the agent introduced the buyer. See [I have a sole agreement with an agent](https://help.propertynow.com.au/en/article/i-have-a-sole-agreement-with-an-agent-can-i-still-list-with-propertynow-exar59/).
* **Open agency:** you're free to market privately and use more than one agency; commission goes to whoever introduced the buyer. See [I have an open agreement with an agent](https://help.propertynow.com.au/en/article/i-have-an-open-agreement-with-an-agent-can-i-still-list-with-propertynow-gctwks/).

Whatever type you have, read the clauses on private sales, buyer introductions and any continuing or protection period after the end date. If anything is unclear, ask the agent to confirm your position in writing or have your solicitor or conveyancer read it. We never charge commission, so the only commission question is the one between you and the agent.

### Your listing starts fresh with us

We don't accept listing transfers from other agencies, so once you're free to go you create a new listing in your account. That gives you a brand new listing on the portals: new ID, new listing date, back at the top of standard results, with no "days on market" carried over from your agent's campaign. The agent's listing needs to come down first; ask them to withdraw it or arrange the transfer on their side. See [How can I transfer my realestate.com.au listing to another agency](https://help.propertynow.com.au/en/article/how-can-i-transfer-my-realestatecomau-listing-to-another-agency-1t43uvw/) for what we can and can't do.

### What to have ready

A recent rates notice, your photo ID and a selfie holding it, and your photos and description. If your agent arranged professional photos, check who owns them before reusing them; many photographers licence images to the agency, not the owner.
